Petitioner is an accused in a case registered for the offence under sections 420, 413, 414, 489A, 489B, 489D, 489E and 120B of the Indian Penal Code.
Petitioner was apprehended with fake currency of Rs.57,700/- in the denomination of Rs.100/- and Rs. 50/- as well as with a motorcycle without number plate. Police has further alleged that the petitioner was arrested as soon as he tried to exchange his fake currency with the police spy. Petitioner also named his associates indulged with him in the racket. Learned counsel for the petitioner submits that no theft case has been lodged for the aforesaid motorcycle. Petitioner has no criminal antecedent and he is in custody since 31.7.2018. Learned counsel disputes the genuineness of the
Patna High Court CR. MISC. No.36584 of 2019(3) dt.04-09-2019 2/2 recovery. Charge sheet has also been submitted in the case. Considering the facts of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur in Sessions Trial No. 878 of 2018, subject to the condition that the petitioner shall fully co-operate with the trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
