JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date: 24-07-2017 This appeal has been preferred by the appellant against the judgment and order of conviction dated 07.05.2002 passed by Adhoc District and Sessions Judge, Fast Track Court No. 1, Saran, Chapra in S.T. No. 92 of 1990/159 of 2001, whereby the appellant was convicted for the offence punishable under Section 307 of the Indian Penal Code and also under Section 3/4 of the Explosive Substance Act and was sentenced to undergo R.I. for five year under Section 307 I.P.C. and R.I. for five years under Section 3/4 of the Explosive Substance Act and all the sentences were directed to run concurrently.

At the very outset, learned counsel for the appellant has submitted that during the pendency of the appeal, the appellant has already died, as such, this appeal has become infructuous. In view of the submission of learned counsel for the appellant this appeal is dismissed as having become infructuous. (Vinod Kumar Sinha, J) sunil/- U T
