JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have opened fire causing fire-arm injury on the chest of injured, Maheshwar Paswan. Paragraph-33 of the case diary reveals that the injured, Maheshwar Paswan was examined by the doctor on 01-01-2015 and the doctor found one injury i.e. 1⁄2"x 1⁄2"x unknown deep on right side of the chest, said to be caused by fire-arms. The opinion regarding the nature of injury was kept reserved. Furthermore, it would appear that the I.O. without obtaining the complete injury report, submitted charge sheet against the petitioner and other accused and furthermore, it is not clear as to whether the aforesaid Maheshwar Paswan got any further treatment or not. Patna High Court Cr.Misc. No.36975 of 2015 (3) dt.03-11-2015 2/2 languishing in jail custody since 06-04-2015. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kashichak P.S. Case No. 01 of 2015 to the satisfaction of Chief Judicial Magistrate, Nawada.
