This application for anticipatory bail arises out of Complaint Case No. 465 of 2013 for the offence punishable under Sections 406 and 420 of the Indian Penal Code. It is alleged in the complaint petition that the petitioner had introduced one Deepak Kumar as an L.I.C. Agent. On persuasion of said Deepak Kumar, the complainant is said to have taken L.I.C. policy. Allegedly, the said Deepak Kumar received considerable amount in the name of depositing premiums against the said policy. The complainant subsequently

Patna High Court CR. MISC. No.40884 of 2019(8) dt.26-06-2020 2/3 learnt that the amount paid by her to said Deepak Kumar to the tune of Rs.77,044/- has been misappropriated for his personal use.

Learned counsel appearing on behalf of the petitioner has submitted that there is no allegation against the petitioner of misappropriation of any amount and only allegation against him is of introducing said Deepak kumar as an Agent of L.I.C.

Considering the nature of allegation made in the complaint petition against the petitioner, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IX, Bhagalpur, in Complaint Case No. 465 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to
