2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 108, 3(5) of the Bharatiya Nyaya Sanhita.

3. According to prosecution case, son of the informant committed suicide under acute mental pressure on account of institution of a false case against him and his family. It is alleged that the petitioner is accountable for this extreme steps taken by the deceased.

4. Learned counsel for the petitioner submits that petitioner is not a family member of Shail Devi who is alleged to have filed false case against informant and others. There is no allegation of any active or direct role attributed to this petitioner leading the deceased to commit suicide. It is further submitted that similarly

Patna High Court CR. MISC. No.38269 of 2025(5) dt.01-12-2025 2/2 situated co-accused persons have already been granted anticipatory bail by co-ordinate Bench of this Hon'ble Court vide order dated 19.11.2025 passed in Cr. Misc. No. 35300 of 2025. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna City in connection with Khajekalan P. S. Case No. 82 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
