The petitioners are languishing in custody since 22.03.2019 in a case registered for the offences punishable under Sections 272, 273, 290 of the Indian Penal Code and Sections 30(a) and 37(a) (b) (c) of Bihar Prohibition and Excise (Amendment) Act, 2018.

It is alleged that from the possession of the petitioners, 10 litres each of country made illicit liquor were recovered.

It is submitted by learned counsel for the petitioners that the petitioners are not having any criminal antecedent,

Patna High Court CR. MISC. No.34962 of 2019(2) dt.28-05-2019 2/2 statement to that effect has been made in paragraph 3 of the petition.

Learned APP submits that the recovery has been made from the petitioners.

Considering the nature of recovery and statement being made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Sigori P.S.
