JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Neither petitioner was caught on the spot nor anything was recovered from his conscious possession. The name of petitioner was disclosed by co-accused, Munna Kumar Ram @ Munna Ram from whose possession the alleged recovery was made. Admittedly, co-accused, Munna Kumar Ram @ Munna Ram has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 24.06.2015 passed in Cr. Misc. No. 27083 of 2015. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.53329 of 2015 (2) dt.26-11-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Gopalganj in connection with Trial No. 25 of 2015 arising out of Gopalganj Town P.S. Case No. 443 of 2014.
