The petitioner seeks regular bail in connection with Kochadhaman P.S. Case No.302 of 2024 registered for the offence under sections 103(1) of the B.N.S., 2023.

The petitioner is suspected to have killed the son of the informant. She is in custody since 13.01.2025. 4.

Learned counsel for the petitioner submits that there is no material to connect the petitioner with the crime except for suspicion.

Learned counsel for the informant submits that three witnesses have seen the petitioner running away from

I have considered the submissions of the parties.

In the opinion of this Court, if three witnesses would have seen the petitioner running away from the place of occurrence then the name of the petitioner would have been mentioned in the F.I.R. as an assailant of the deceased and not as a suspect.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj / concerned Court below, in connection with Kochadhaman P.S. Case No.302 of 2024.
