JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 419/34 of the Indian Penal Code.

The prosecution case is that co-accused, Shiv Balak Kumar, was appearing in the matriculation examination, 2015 at the centre R.D.H. +2 school, Rajgir (Nalanda) in place of the petitiner.

It is submitted by the learned counsel for the petitioner that petitioner was not aware of the fact that co-accused, Shiv Balak Kumar, was appearing at the examination in his place and, even assuming the accusation, at best case under section 419 of

Patna High Court Cr.Misc. No.6907 of 2016 (2) dt.16-02-2016 2/2 the IPC is made out which is bailable.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 53 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
