JUSTICE RAKESH KUMAR ORAL ORDER 14-12-2015 Heard Sri Ravi Shankar Sahay, learned counsel, who was assisted by Sri Milind Kumar Mishra, learned counsel for the petitioner and Sri Chandra Bhushan Prasad, learned A.P.P. The petitioner, who is in custody in connection with Bagaha P.S. Case No. 357 of 2015 registered for the offence under Section 414 of the Indian Penal Code, 25 (1-B)A, 26, 35 of the Arms Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated. It has been argued that petitioner had taken lift from the accused who was driving motor cycle and on apprehension recovery of arms was made from the possession of the person who was driving the motor cycle namely Binod Kushwaha.

Patna High Court Cr.Misc. No.52824 of 2015 (2) dt.14-12-2015 2/2 Learned A.P.P. has opposed the prayer of bail. In view of the nature of accusation and the period of custody, let the petitioner namely Tarjan Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha P.S. Case No. 357 of 2015.
