JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-03-2021 The present writ petition has been filed for quashing the order dated 24.05.2018 passed by the Sub Divisional Officer, Hilsa, Nalanda, whereby and whereunder the P.D.S. License No. T-01/2012 of the Public Distribution Shop of the petitioner, has been cancelled.

Considering the fact that there is provision of appeal under Rule 32 sub-clause (3) of the Bihar Targeted P.D.S. Control Order, 2016, the learned counsel for the petitioner seeks liberty to file appropriate appeal before the appellate authority, however, he prays that the limitation, if any, be directed to be

Accordingly, the present writ petition stands disposed off with liberty to the petitioner to file appropriate appeal against the aforesaid order dated 24.05.2018 and in case such an appeal is filed within a period of two weeks from today, the appellate authority shall consider the same on merits and pass a reasoned order, in accordance with law, however, without being impeded by the issue of limitation.
