2. The present Criminal Miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "the BNSS") for seeking regular bail in connection with Bodhibigha P.S. Case No.76 of 2024 lodged on 26.11.2024 under Section 103 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, the F.I.R. has been lodged against unknown accused persons who alleged to kill the mother of the informant in the night.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner is not named in the FIR. From the FIR, it
Patna High Court CR. MISC. No.35431 of 2025(2) dt.05-06-2025 2/2 becomes crystal clear that the informant with his niece (bhagini) sitting in the same room and in the morning, her neck was cut and dead body was found.
5. Learned Counsel further submits that petitioner is in custody since 30.12.2024 having clean antecedent.
6. Learned counsel for the State opposes the prayer for bail and submits that weapon of the crime has been recovered from the accused, namely, Lalu Kumar (not named in the FIR) has accepted his involvement in the crime along with the petitioner, who has disclosed the name of present petitioner and one other co-accused person.
7. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
