1. Heard learned Senior counsel for the petitioner, Mr. N.K. Agrawal and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Sare P.S. Case No. 41 of 2026 registered for the offences punishable under Sections 103(1) and 3(5) of the BNS, 2023.

3. Learned Senior counsel appearing on behalf of the petitioner submits that petitioner has antecedent of six cases and the informant alleges that his father on 02.03.2026 was working in the field when Manu and petitioner came along with

Patna High Court CR. MISC. No.36941 of 2026(2) dt.15-06-2026 2/3 unknown accused and assaulted his father brutally causing injury on head, chest and hands, further his father died during the course of treatment at Patna.

4. Learned Senior counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant is not an eye witness to the occurrence. It is also submitted that even allegation of assault is general and omnibus in nature.

Learned A.P.P. for the State vehemently opposes the anticipatory bail application of the petitioner and submits that petitioner has antecedent of six cases and there is a specific allegation against the petitioner along with others of assaulting the father of the informant leading to his death during the course of treatment. It is next submitted that case is in the nascent stages of investigation and if privilege of anticipatory bail is granted, the petitioner may abscond.

6. After hearing the learned counsel for the parties, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner taking into consideration the fact that father of the informant died and petitioner has antecedent of six cases.

7. Accordingly, the instant anticipatory bail application stands rejected.
