Patna High Court C.Misc. No.541 of 2024 dt.28-10-2024 2/3 CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL JUDGMENT Date : 28-10-2024 Today the matter has been listed under the heading "For Orders (On Office Notes)". However, on the prayer of the parties, the matter is taken up for its disposal.

2. Heard learned counsel for the petitioner and learned counsel for the respondent nos. 2 to 4.

3. The learned counsel for the petitioner submits that he limits his prayer only for early disposal of Partition Suit No. 596 of 2004 pending before the court of learned Sub Judge-VI, Vaishali at Hajipur.

4. The learned counsel for the respondent nos. 2 to 4 has got no objection to such prayer.

5. Since the petitioner has limited his prayer only for expeditious disposal of Partition Suit No. 596 of 2004 pending before the learned trial court, I do not think there is any need for service of notice upon other respondents and the present matter could be disposed of straightaway as it is with regard to an old suit of the year 2004.

6. Expeditious disposal of the civil suit is in the interest of parties and in general public as well and there could be no denial of this fact.

7. Having considered the aforesaid facts and

No.541 of 2024 dt.28-10-2024 3/3 circumstances as well as submission made on behalf of the petitioner, the learned Sub Judge-VI, Vaishali at Hajipur is directed to expedite the proceeding of Partition Suit No. 596 of 2004 and try to conclude the same on its merits and in accordance with law preferably within a period of nine months from the date of receipt/production of a copy of this order, without adjourning the matter unnecessarily.

8. At the same time, the parties are directed to cooperate in the matter for its early disposal without seeking unnecessary adjournment.
