This application for anticipatory bail arises out of Barun P.S. Case No. 09 of 2009 for the offence under Sections 147, 148, 149, 323, 325, 307, 379, 385, 427 and 506 of the Indian Penal Code.

The First Information Report was registered in 2009, whereafter the petitioners had approached this Court for grant of anticipatory bail, which was rejected by order dated 27.08.2009 passed in Cr. Misc. No. 22705 of 2009. Nearly ten years thereafter, the present anticipatory bail application is being filed, which is not only misconceived, the same is abuse of the process of the Court.

No.38774 of 2019(2) dt.25-06-2019 2/2 The petitioners are directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If they do so, their application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
