JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 364 and 379 of the Indian Penal Code and later on Sections 302, 201, 34 of the Indian Penal Code was also added.
Petitioner is not named in the present case but it would appear from perusal of the case diary that the dead body of the driver of the vehicle was recovered and police lodged Warsliganj P. S. Case No. 237 of 2013 for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Furthermore, it would appear that subsequently, the
Patna High Court CR. MISC. No.35329 of 2019(4) dt.20-11-2019 2/2 stolen vehicle of the present case was recovered and 12 persons including one Kanhaiya Kumar were arrested whereas other persons managed to escape from there. The confessional statement of Kanhaiya Kumar was recorded and in his confessional statement, the aforesaid Kanhaiya Kumar disclosed the name of the petitioner and except the aforesaid material, there is nothing against the petitioner, who is in jail custody since 22.02.2019 and, admittedly, the investigation against the petitioner has already been completed. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeXV, Patna in connection with GRP Bakhtiyarpur P. S. Case No. 88 of 2013.
