The petitioner has prayed for bail in a case registered for the offence punishable under sections 447, 448, 323, 354(B), 324, 307, 498A, 504, 506/34 of the Indian Penal Code and sections 3 and 4 of D.P. Act.

As per allegation in the FIR, petitioner is husband of the informant and when he was assaulting his wife, she came to her parental house with a view to save her life. It is further alleged that petitioner along with his family members came to his sasural and started to assault his wife and her family members as a result of which three ladies sustained injuries. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.39221 of 2022(3) dt.10-01-2023 2/2 that petitioner is innocent and he has been falsely implicated in this case. No specific overt act is attributed to the petitioner. Petitioner is husband of the informant and due to some family dispute, there is case and counter case. Petitioner is in custody since 25.03.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Kahalgaon (Shivnarayanpur) P.S. Case No. 895 of 2021.
