1. Heard learned counsel for the petitioners, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant, Mr. Prakash Kumar.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 447, 341, 323, 324, 325, 307 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioners, at the outset, seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 3 (Shyamdeo Yadav).

4. Accordingly, the present anticipatory bail application is dismissed as withdrawn with respect to petitioner no. 3 only.

5. It is next submitted that the petitioners are persons with clean antecedent and the informant alleges that on 03.03.2024 while he was going to work as a labourer then all the named

No.44919 of 2024(2) dt.21-08-2024 2/2 accused persons including the petitioners intercepted him being his agnates and Kaleshwar Yadav gave orders to kill on which Ajay assaulted the informant by lathi while Shyamdeo assaulted by axe. It is further submitted that the injury suffered by the informant on head is grievous, but then allegation of assaulting the informant is on Shyamdeo Yadav.

6. Learned A.P.P. for the State along with learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail of the petitioners.

7. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jhajha P.S. Case No. 95 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
