2. The petitioner seeks bail in Raghopur P.S. Case No. 189 of 2023, registered for the offences under Sections 302/34 of the Indian Penal Code.
3. The allegation is that the younger brother of the informant was killed in the matrimonial house (Sasural) of the informant. When his elder brother, Gauri Shankar Das, went to the matrimonial house, he found his younger brother lying on a cot in the courtyard (Aangan) with a ligature mark on his neck. There was a suspicion that he had been strangulated by the petitioner and others.
4. Learned counsel for the petitioner submits that there is no eyewitness to the occurrence. He further submits that

No.36205 of 2026(3) dt.08-07-2026 2/3 upon receiving information, when the elder brother went to the matrimonial house, he found his younger brother lying on the bed in the courtyard (Aangan) with a ligature mark on his neck. He further submits that the co-accused, namely, Pram Das @ Parmanand Das @ Vina, has been granted bail by a Co-ordinate Bench of this Court vide order dated 31.07.2024 passed in Cr. Misc. No. 33126 of 2024, on the ground that the informant had come and scolded the deceased, telling him not to marry one Archana Kumari, following which the deceased committed suicide. He also submits that the petitioner has been named in the case based purely on suspicion. It is next submitted that the petitioner has been in custody since 23.02.2026 and has no criminal antecedents.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering that there is no eyewitness to the occurrence, that the petitioner has been in custody since 23.02.2026, and that he has no criminal antecedents, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No.36205 of 2026(3) dt.08-07-2026 3/3 Additional Chief Judicial Magistrate-XV, Vaishali at Hajipur in connection with Raghopur P.S. Case No. 189 of 2023.
8. It is made clear that any observation made herein is prima facie in nature and limited solely to the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
