JUSTICE RAKESH KUMAR ORAL ORDER 15-12-2015 Heard Sri Dhirendra Nath Jha, learned counsel for the petitioner, learned A.P.P. as well as Sri Rajeev Ranjan Singh, learned counsel who has voluntarily appeared on behalf of the informant/ opposite party no. 2.

The petitioner who is in custody since 4.9.2015 in connection with Mahila P.S. Case No. 36 of 2015 registered for the offence punishable under Section 498A of the Indian Penal Code, Section 3 / 4 of the Dowry Prohibition Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that his wife is repeatedly filing cases against the petitioner. In one of the case which was filed by the wife the petitioner was in custody and when the petitioner was bailed out or directed to be

Patna High Court Cr.Misc. No.52506 of 2015 (3) dt.15-12-2015 2/2 released he has again been taken into custody in the present case on remand.

Sri Rajeev Ranjan Singh, learned counsel for the informant has vehemently opposed the prayer of the petitioner. He submits that the wife is still ready to reside with the petitioner. Be that as it may, keeping in view the nature of accusation and the period of custody, let the petitioner Rajesh Ranjan be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Mahila P.S. Case No. 36 of 2015.
