The petitioner seeks bail in a case registered under Sections 406, 409 and 420 of the Indian penal Code. It has been contended on behalf of the petitioner that F.I.R. has been lodged in view of the fact that rice miller who has received the paddy could not return to custom milled rice, however, the petitioner was the store keeper of S.F.C. godown at that point of time. He cannot be blamed if the rice miller has not returned the custom milled rice. He could only be blamed if the rice is returned by the rice miller and that rice is misappropriated

Having regard to the facts and the circumstances of the case, the petitioner, Gul Mohammad Ansari is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Nawanagar Police Station Case No.69 of 2015.
