JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 341, 447, 323, 324, 307, 379, 504, 354B, 506 of the Indian Penal Code.

It is a case of free fight between the informant and the petitioner. Petitioner assaulted to Rajesh Kumar by means of Dab causing injury on his hand and leg.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. There is case and counter case between the parties. Specific allegation of assault is against the petitioner to assault Rajesh Kumar. From perusal of injury report, inury are simple in nature caused by

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Magistrate, VIII, Motihari in connection with Patahi P.S Case No. 230 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
