The petitioner seeks bail in Sessions Trial No. 313 of 2014, arising out of Kharik P.S. Case No. 158 of 2013 registered under Sections 302/34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this Court, vide order dated 12.09.2014, passed in Cri. Misc. No. 30089 of 2014.

In view of the allegation that the petitioner repeatedly assaulted with spade on the head of the mother of the informant as a result of which she died, I am not persuaded to take a different view in the matter, even though he is in custody since 20.02.2014. Accordingly, the application is rejected.
