The appellant has challenged the order dated 27.08.2020, in connection with Phulwariaya P. S. Case No. 202 of 2019 dated 14.10.2019, passed by the learned Additional District and Sessions Judge, 1st, Gopalganj, whereby the prayer for grant of bail has been rejected by the court below.
From the perusal of the F.I.R., it appears that the dispute arose because of the accused persons including the appellant trying to sell liquor in an
Patna High Court CR. APP (SJ) No.2145 of 2020(2) dt.05-01-2021 2/3 unauthorized manner. The informant had protested to such sale of liquor in an unauthorized manner. So far as the appellant is concerned, he is stated to have assaulted the informant by means of Lathi.
The injuries suffered by the informant is stated to be simple in nature.
The appellant is in custody since 22.07.2020 and is a person of clean antecedents.
Regard being had to the afore-stated facts, the order dated 27.08.2020, in connection with Phulwariaya P. S. Case No. 202 of 2019 dated 14.10.2019, passed by the learned Additional District and Sessions Judge, 1st, Gopalganj, is set aside.
The appellant, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, 1st, Gopalganj in
Patna High Court CR. APP (SJ) No.2145 of 2020(2) dt.05-01-2021 3/3 connection with Phulwariaya P. S. Case No. 202 of 2019.
The appeal stands disposed off accordingly.
