JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 304(B), 328/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of informant, Ragini Devi, after about six years of the marriage for non-fulfillment of demand of dowry.
It is submitted by the learned counsel for the petitioner that omnibus and general accusation has been levelled against all family members, including the petitioner, other co-accused have already been granted anticipatory bail and the informant has retracted from his initial version.
Considering the fact that the case was registered in the
Patna High Court Cr.Misc. No.6928 of 2016 (2) dt.16-02-2016 2/2 year 2010 and the present anticipatory bail petition has been preferred in the year 2016, this court is not inclined to grant anticipatory bail to the petitioner but keeping in view the fact that other co-accused have already been allowed anticipatory bail, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Aurai P.S. case No. 128 of 2010 pending in the court of Sri Javed Alam, learned J.M., 1st class, Muzaffarpur.
This application is disposed of with the aforesaid observation/direction.
