JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B, 384 and 504 of the Indian Penal Code. The prosecution case is that the agnate of the informant Devendra Mishra executed the sale deed with regard to a land bearing Khata No. 96, Plot No. 774 measuring area of 4 katha 13 dhurs under the mauza Tilath in favour of the Bhairab Paswan though the said land was lying in the joint possession of five brothers of the informant. It is alleged against the petitioner that he was the witness to the alleged sale deed.
It is submitted by learned counsel for the petitioner that thrust of accusation is against executor of the sale deed, Devendra
Patna High Court Cr.Misc. No.8624 of 2016 (2) dt.23-02-2016 2/2 Mishra.
Considering the thrust of accusation against Devendra Mishra and nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Jhanjharpur, Madhubani in connection with Ghoghardiha P.S. Case No. 03 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
