The petitioner apprehends his arrest in Excise case No. 603/19, arising out of Udwant Nagar P.S. case No. 113/19, registered under Section 30(a) of the Bihar Prohibition & Excise Act.
The informant alleged that one person was carrying a bag but after seeing the police the suspect fled away leaving the bag on the spot. From the bag 5.4 liter of liquor was recovered. The Chowkidar is said to have disclosed that petitioner was carrying the bag.
The learned counsel for the petitioner submits that Chowkidar is co-villager of the petitioner and petitioner has got personal enmity with Chowkidar. The petitioner was not carrying any bag containing liquor.

No.33980 of 2019(2) dt.23-05-2019 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Bhojpur, Ara in connection with Excise case No. 603/19, arising out of Udwant Nagar P.S. case No. 113/19, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
