In this case, the petitioner is seeking regular bail in connection with Rauta P.S. Case No. 113 of 2019, registered for the offence under Sections 420, 413, 414/34 of the Indian Penal Code.

Allegation has been made against the petitioner to have involved in snatching the motor-cycle.

Earlier, this petitioner had moved before this Court in Criminal Miscellaneous No.78677 of 2019 and this Court vide order dated 04.12.2019 rejected the prayer for bail of the petitioner with a liberty that he may renew his prayer for bail after nine months of judicial custody.

The petitioner has no criminal antecedent as has been stated in paragraph no.3 of the bail petition, inasmuch as,

Patna High Court CR. MISC. No.35299 of 2020(2) dt.21-12-2020 2/2 he is in jail since 19.09.2019.

Looking to the period of custody, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Rauta P.S. Case No. 113 of 2019, subject to the condition that the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.

However, at the time of accepting bail bonds, the court below would verify and assure itself regarding the criminal antecedent of the petitioner. If he is having clean antecedent, then his bail bond would be accepted. If he is found to be involved in any other case before filing of this application i.e. 16.12.2020 then his bail bond would not be accepted. (Shivaji Pandey, J) pawan/- U T
