====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Hajipur Sadar P.S. Case No.240 of 2020, registered for the offence under Section 392 of the Indian Penal Code.

As per the prosecution case, four unknown miscreants riding on two motorcycles intercepted the informant, who was sitting on scooty with her brother, and thereafter, on the point of pistol looted golden chain, mobile and purse from them and fled away towards east direction.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and no incriminating / looted article has been recovered from his possession. Till date, petitioner has not been put on T.I.P. and he is in custody since

Patna High Court CR. MISC. No.46149 of 2021(3) dt.04-01-2022 2/2 20.06.2020. Chargesheet has been submitted.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has confessed his guilt before the police and looted Aadhar Card of informant has been recovered from his (petitioner) possession and petitioner has got criminal antecedent also.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
