2. The petitioner is apprehending arrest in connection with Complaint Case No. 2054 of 2023 instituted under Sections 323, 504, 498(A) and 494 of the Indian Penal Code filed by the complainant, Meena Devi.

3. As per the prosecution story, the complainant alleged that she was married to the petitioner in the year 2013 but was always tortured for dowry and in between, four children arrived in this world. She tried her best to save the marriage but torture continued and lastly, she was ousted as the lady got information that the petitioner has gone for second marriage. This led to the case.

4. Learned counsel for the petitioner submits that he has not gone for the second marriage. He is ready to keep the wife.

5. This Court earlier wanted amicable settlement between the parties. On 07.11.2025, the husband undertook to take the children as also the wife to the home but he failed to do so as per the information given by the learned counsel for the informant/complainant.

Learned counsel for the petitioner submits that on his own, he would like to pay Rs. 8000/- per month to the lady/children which shall go to the bank account of the complainant bearing Account No. 50121906107 (IDID000K842) branch-Kurhani by 10th of every month and if he fails to do so, the Court/the lady shall be free to take steps for cancellation of bail bonds, if granted relief.

7. Learned counsel for the informant/complainant that she has lots of grievance against the petitioner but now he is trying to take care of the children, for the present, has no objection.

8. Taking into account the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail to the petitioner subject to the payment of 8000/- per month to the

3/4 lady/children which shall go to the bank account of the complainant bearing Account No. 50121906107 (IDID000K842) branch-Kurhani by 10th of every month and if he fails to do so, the Court/the lady shall be free to take steps for cancellation of bail bonds, if granted relief.

Let the petitioner be released on bail, in the event of his arrest or surrender before the subordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each in connection with Complaint Case No. 2054 of 2023 to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Hajipur at Vaishali subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also the other conditions.

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall co-operate in the investigation

4/4 and make himself available to the police as and when required; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
