Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and name of the petitioner came in the confessional statement of co-accused Munna who was apprehended by the informant and police officials just after alleged occurrence.

Petitioner carries criminal antecedent but submission on behalf of the petitioner is that co-accused Munna has already been granted privilege of bail by a coordinate bench of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Araria P.S. Case no. 239/2015.
