Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The prosecution case is that the informant parked his motorcycle in front of the shop of petitioner and went to enjoy the cultural programme in a fair. On return, he found that his motorcycle missing.

It is submitted by the learned counsel for the petitioner that only on suspicion accusation has been levelled. There is no recovery from the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the suspicious nature of accusation, it

No.6434 of 2016 (2) dt.11-02-2016 is a case for consideration of regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Budhuchak P.S. Case No. 27 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Bhagalpur. With the above observation this application is disposed of.
