ANJANA PRAKASH ORAL JUDGMENT Date: 29-02-2016 The Petitioner seeks revision of the judgment of conviction dated 29.11.2014 passed by the Sessions Judge, Kaimur at Bhabua in Criminal Appeal No.38 of 2012/ 107 of 2014, by which he has upheld the conviction of the Petitioner under the provisions of Arms Act and maintained the sentence of 2 years S.I. and fine of Rs.5000/-, in default of which simple imprisonment for another three months, passed by judgment dated 16.5.2012 by the Judicial Magistrate, 1st class, Bhabua in G.R. No.1404 of 2011 (Trial No.1752 of 2012) arising out of Chand P.S. case No.64 of 2011. Having gone through the impugned judgment, I do not find any reason for interference. However, considering that the Petitioner has remained in custody for about a year, the sentence is

Patna High Court CR. REV. No.912 of 2015 dt.29-02-2016 2/2 modified to the period already undergone by him. However, he is required to deposit the fine as directed by the Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.

With the aforesaid modification in sentence, the revision application stands dismissed.
