JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One loaded country-made pistol and two live cartridges are said to have been recovered from conscious possession of the petitioner. Earlier petitioner was made accused in three cases in the year, 2015.
The contention on behalf of the petitioner is that the present as well as earlier cases are nothing but only a glaring example of high handedness of police and that is the reason, petitioner was remanded in almost all the cases within a very short span of time.
Considering the above-said facts and circumstances of the case as well as period of detention of the petitioner in jail
Patna High Court Cr.Misc. No.54391 of 2015 (2) dt.07-12-2015 2/2 custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kharik P.S. Case No. 108 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Naugachia, Bhagalpur.
