The petitioners apprehend their arrest in a case

2/5 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code read with Section 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019.

petitioners are persons with clean antecedent and the informant alleges that a raid was conducted near Tahsur River where a tractor loaded with 17850 square feet sand and an accused were apprehended and brought to the police station, it is next alleged that the illegal mining caused loss of revenue to the Government to the tune of Rs. 9,44,975/- and on inquiry it was found that the petitioners along with four others were indulging in illegal sand mining.

petitioners have been falsely implicated in the present case, it is next submitted that petitioners were not apprehended from the place of occurrence as such nothing was recovered from their conscious possession, further the petitioners are neither the owner nor the driver of the alleged tractor and it seems that the informant with a view to save the real culprit has not tried to find out that who is the owner of that tractor rather has alleged that based on inquiry he came to know that petitioners along

3/5 with four others were indulging in illegal mining. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jagdishpur P.S. Case No. 66 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
