The petitioner, who is in custody in connection Khudwan P.S. Case No. 43 of 2014 registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act, has prayed for grant of bail. Learned counsel for the petitioner submits that ofcourse in the F.I.R. it has been alleged that petitioner had fired upon the husband of the informant and in the occurrence husband of the informant died, fact remains that petitioner being Mukhiya of the Gram Panchayat has falsely been implicated due to village politics. On the aforesaid grounds a prayer has been made for grant of bail.

Patna High Court Cr.Misc. No.52326 of 2015 (2) dt.03-12-2015 2/2 On perusal of paragraph no. 3 of the petition it is evident that petitioner is a habitual offender. Moreover, from the F.I.R. it is evident that the petitioner is the only assailant in the case.

The bail petition stands dismissed.
