JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Jamui P.S. Case No. 138 of 2021, instituted for the offences under Sections 326, 302/34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 08.06.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case. As per FIR, the informant alleged that his brother was assaulted by Ranjan Bind and Nawal Bind by axe and other accused also alleged to have assaulted by axe leading to death of the brother of the informant.

The learned counsel for the petitioner submits that the petitioner is not named in the FIR. His named transpired in the

Patna High Court CR. MISC. No.46454 of 2021(2) dt.06-01-2022 2/2 case based on suspicion. Learned counsel also submits that the petitioner is a old man aged about 77 years.

Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 08.06.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case and is aged about 77 years, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui, in connection with Jamui P.S. Case No. 138 of 2021.

The application stands allowed.
