JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant having got confidential information about the manufacturing of country made liquor illegally, he alongwith other police officials proceeded for the alleged place of occurrence and found that 20 persons were engaged in manufacturing of country made liquor. The police arrested the petitioner and his associates and seized 80 liters country made liquor and other apparatus which have been used in manufacturing the illicit liquor.

The contention on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner

Patna High Court Cr.Misc. No.53881 of 2015 (2) dt.30-11-2015 2/2 and as a matter of fact, original culprits fled away from the place of occurrence having been seen the police party and petitioner was caught by the police on mere suspicion.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S.No.348 of 2015.
