2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act.

3. It is alleged that total 585.00 liter Banti Babli country made wine was recovered from Bolero and motorcycle.

4. It is submitted that petitioner's name has figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is neither the owner nor driver of the vehicle in

5. Learned counsel for the State opposes the bail petition.

6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Learned Addl. District & Sessions Judge -II-Cum-Exclusive Special Excise Court No.-I Gopalganj in connection with Uchakagaon Police Station Case No . 121 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
