The petitioner apprehends his arrest in G.O. Case No.57 of 2016 under Section 47(a)(F) of the Excise Act. Excise Officials and other force recovered 15 liters of illicit liquor and 150 kg. Jawa Mahua along with equipment meant for manufacturing country made liquor from a lonely place but the Excise Officials alleged that the petitioner owns the place and he was manufacturing country made liquor. It is submitted that there is no material to show that the petitioner was manufacturing liquor and nothing has been recovered from possession of the petitioner. Considering the fact that nothing has been recovered from the petitioner, petitioner above named is directed to be released on anticipatory bail in the event of arrest or surrender

Patna High Court Cr.Misc. No.39476 of 2016 (3) dt.23-09-2016 2/2 before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with G.O. Case No.57 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
