JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-03-2016 Heard learned Counsel for the petitioner, the South Bihar Power Distribution company Limited and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Rajpur Police Station Case No. 111 of 2015, disclosing offences under Section 135 of the Electricity Act. It is alleged that the petitioner has committed theft of electricity from L. T. Line by using a metal hook for the purpose of running his business of a flour mill. Allegedly, by his act, the petitioner caused loss to the South Bihar Power Distribution company Limited, amounting to Rs. 2,12,816/-.
Learned Counsel for the petitioner submits that
Patna High Court Cr.Misc. No.6155 of 2016 (4) dt.10-03-2016 2/2 the petitioner is ready to deposit the said amount of Rs. 2,12,816/- in the account of South Bihar Power Distribution Company Limited, in four equal monthly instalments, starting from 15th March, 2016.
Considering the fair stand taken on behalf of the petitioner, this application is allowed.
Let the petitioner, Tribhuwan Singh, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Rajpur Police Station Case No. 111 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
