Petitioner apprehends his arrest in Complaint Case No.C-173 of 2014 instituted for the offence under Section(s) 406, 420, 323, 504 Indian Penal Code.

Counsel for the petitioner submits that petitioner was earlier granted anticipatory bail by order dated 02.05.2018 passed in Cr. Misc. No.9627 of 2018 with certain conditions. Thereafter, petitioner filed Cr. Misc. No.56520 of 2018 for modification of the order dated 02.05.2018 passed in Cr. Misc. No.9627 of 2018, which was allowed by order dated 12.09.2018. By order dated 13.02.2019 passed in Cr. Misc.

Patna High Court CR. MISC. No.43579 of 2019(3) dt.24-07-2019 2/2 No.56520 of 2018, the petitioner was directed to surrender before the Court below and make prayer for regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order.

Therefore, this Court is not inclined to modify the order dated 13.02.2019 passed in Cr. Misc. No.56520 of 2018. Counsel for the petitioner submits that he has already returned the bricks. He is having valid receipts with regard to same.

In such circumstances, this application is disposed off with direction to petitioner to surrender in the Court below within four weeks from date of receipt of copy of this order in connection with Complaint Case No. C-173 of 2014 along with valid receipts showing return of the bricks, as ordered earlier, and, in that event, the Court below will pass appropriate order in accordance with law preferably on same day without being prejudiced by order of this Court.
