====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 29-01-2021 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking regular bail in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No.188 of 2020 registered for offence punishable under sections 147, 149, 341, 323, 307, 504 of the Indian Penal Code and later on, section 302 of the Indian Penal Code has been added. On account of dispute for hand-pump, the petitioner and other accused persons assaulted the informant and his family members, including his father and the father of the informant succumbed to injury.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner to have caused injury in any manner but learned counsel for the informant has

Patna High Court CR. MISC. No.33932 of 2020(2) dt.29-01-2021 2/2 pointed out that it is the petitioner and other accused persons involved in assaulting the father of informant and in post mortem report, the doctor has found five injuries on the body of the deceased.

Looking to the nature of allegation, for the present, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However the petitioner may renew his prayer for bail after one year of jail custody.
