JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-03-2016 Heard learned counsel, appearing on behalf of the petitioner, and the learned Addl. Public Prosecutor, appearing on behalf of the State.

This application for grant of anticipatory bail arises out of Masaurdhi P.S. Case No. 68/2013, disclosing offences under sections 302, 201/34 of the Indian penal Code. Learned counsel for the petitioner has submitted that the implication of the petitioner is based on mere suspicion and nothing has been collected in course of investigation so far, which can be said to be worth evidence for connecting the petitioner with the commission of offence.

However, considering the fact that the petitioner's custodial interrogation may be required, I am not inclined to grant the petitioner privilege of anticipatory bail.

Patna High Court Cr.Misc. No.6342 of 2016 (3) dt.10-03-2016 This application is, accordingly, rejected.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
