This is a petition for grant of regular bail for the offence under Sections 15, 18 and 20 of the N.D.P.S. Act. F.S.L. report has been received in a sealed cover and it has been opened in the Court in which it has been reported that the small polythene packet contained some brown coloured husky substances having characteristic smell and it has been opined that Morphine alongwith other alkaloids of Opium were detected in the contents of small polythene packet.
However, having regard to the fact that 72 Kg. of Doda has been recovered which comes within the commercial quantity, I am not inclined to grant bail to the petitioner. The same is rejected
Patna High Court Cr.Misc. No.54162 of 2015 (6) dt.25-02-2016 2/2 in connection with Barachatti P.S. Case No. 241 of 2015, pending in the court of the learned Sessions Judge, Gaya. F.S.L. report is hereby directed to be sent down in a sealed cover to the court below.
