Although petitioner is named in the first information report but according to the prosecution case itself, petitioner was apprehended from his house by the informant and after that present case was lodged . Petitioner does not have any criminal antecedent and is languishing in jail custody since 03.09.2015. Admittedly nothing has been recovered from conscious possession of the petitioner.
