====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-02-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Tisiauta P.S. Case No.23 of 2019 registered under Sections 341, 323, 307, 427, 436, 504 and 506/34 of the Indian Penal Code. The accusation is that on 20.03.2019, 14 persons, named in the F.I.R., including the petitioner Umesh Paswan put fire in the house of Bhuneshwar Paswan and damaged the households articles worth of 70,000/-. At that time, they also caused cut injury at the forehead of the informant Virendra Paswan through sword, due to which the informant fell down on the ground. At that time, Umesh Paswan (petitioner) and Vikas Paswan with an intention to kill gave Garasa blow at Karan

Patna High Court CR. MISC. No.33777 of 2020(4) dt.05-02-2021 2/2 Kumar. On the order of Sonu Paswan, Shankar Paswan and Mahesh Paswan caused injury through Farsa at the head of the informant. The informant further alleged that he was also assaulted by Ganesh Paswan and Dilip Paswan.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the specific allegation against the petitioner and co-accused Vikas Paswan is to cause injury to Karan Kumar but only one lacerated wound over the right parietal region of his head in diameter of 2" x 1/2" x skin deep was found, which appears to be simple in nature. The petitioner is in custody since 18.08.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Vaishali at Hajipur, in connection with Tisiauta P.S. Case No.23 of 2019.
