2. The petitioners are apprehending their arrest in Raniganj P.S. Case No. 428 of 2024 registered under Sections 108/ 3(5) of the BNS, 2023.

3. As per the prosecution case, wife of the informant (the deceased) took loan of Rs. 2,00,000/- from a Finance Company in the absence of the informant and gave it to petitioner namely, Bebi Devi (Cr. Misc. No. 43276 of 2025) but Bebi Devi cheated him and did not returned the money. It is alleged that in absence of

Patna High Court CR. MISC. No.34601 of 2025(6) dt.11-11-2025 2/2 informant, petitioner namely, Nasim Khan (Cr. Misc. No. 34601 of 2025) impersonated him by using his Aadhar Card. When Bebi Devi left the village, manager of the Company started visiting house of the informant asking for payment of loan due to which wife of the informant (the deceased) hung herself due to tension and died. It is further alleged that Bebi Devi has cheated about 30 people.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in the present case.

5. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners and submitted that two women, Phagunia Devi and Gudia Devi, who were also cheated by the petitioners, have rendered their statement under Section 180 of the BNSS, which is annexed with the case diary.

6. Considering the aforesaid facts and circumstances, in my view, the petitioners do not deserve the privilege of anticipatory bail. Accordingly, it is rejected.
