The petitioner seeks bail in connection with Sultanganj P.S. Case No. 57 of 2015 (G.R. Case No. 1014 of 2015) registered for the offences punishable under Sections 386, 387, 379/34 & Sec. 411of the Indian Penal Code. The petitioner is not named in the First Information Report. One Pankaj Mandal, son of Saudagar Mandal is named in the First Information Report and as submitted he was apprehended with Gautam Kumar Yadav and others with looted vehicle. From possession of the petitioner nothing was recovered and merely in the name of similarity he has been apprehended on 03.04.2015 vide paragraph 34 of the case diary, there is no legal and tangible material against the petitioner and as such he deserves sympathetic consideration. Patna High Court Cr.Misc. No.677 of 2016 (3) dt.09-03-2016 2/2 Ranveer Kumar @ Ranveer Mamdal, Sachin Kumar @ Sanni & Santosh Sah have been granted bail by other co-ordinate Bench of this Court.
In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case 57 of 2015 (G.R. Case No. 1014 of 2015), subject to conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
