The petitioner seeks bail in Sahar P.S. Case No. 247 of 2020, registered for the offence under Section 302, 120B of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, the informant got information that his son has been killed by fire-arm and suspicion was raised against F.I.R. named co-accused persons. It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. and name of the petitioner has come during course of investigation in the re-statement of the informant wherein it has been alleged that this petitioner had also illicit relation with said Khushbu Kumari, as a result of which, this petitioner alongwith co-accused committed the
Patna High Court CR. MISC. No.47574 of 2021(2) dt.22-01-2022 2/2 murder of son of informant. Having identical and similar allegation, co-accused Chullu Baba has already been granted bail by this Court, vide order dated 17.01.2022 passed in Cr.Misc. No. 34144 of 2021. Petitioner is in custody since 13.04.2020.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 6, Bhojpur, Arrah in connection with Sahar P.S.
